It is high above the max line of the water, so water will not come in contact with it, but it is in there with the steam.
Packaging/appearance
There is a light to let you know it is on, and the switch flips up when the water is boiled, shutting off the kettle.
I got it for 25$ cad, and few days later its selling for 60$+ by 3rd party sellersi was lucky to buy it before its out of stock, nice!
